Terms and Conditions, Returns and Refunds

Last updated: 30 September 2026

1. About us and how to contact us

These terms apply to every order placed on myhighlandphotography.com. Please read them before you buy. By placing an order you accept them.

My Highland Photography is run by Pat McElhinney, a sole trader based in the Scottish Highlands.

  • Business name: My Highland Photography (Patrick McElhinney)
  • Address: 74 Kilmallie Road, Caol, Fort William, PH33 7EL, Scotland, United Kingdom
  • Email: pat@myhighlandphotography.com
  • Website: myhighlandphotography.com
  • VAT: We are not VAT-registered, so no VAT is charged.

Email is the quickest way to reach us. We aim to reply within 2 working days.

2. How your order works

Our contract with you starts when your payment is accepted and we send your order confirmation email. Please keep that email, because it is your record of the order and of these terms.

  • These terms are for personal customers buying for their own use. If you want to use our photographs for a business, please see section 5.
  • Before you pay, the checkout shows everything in your basket, the total price and any postage. You can change or remove anything until you press Place order.
  • If we make an obvious mistake with a price or a description, we will contact you before sending anything. You can then go ahead at the correct price or cancel for a full refund.
  • If a calendar sells out after you order, we will tell you straight away and refund you in full.

3. Prices and payment

All prices are in pounds sterling (GBP), and the price you see is the price you pay. We are not VAT-registered, so no VAT is added. Postage for calendars is added at checkout and shown before you pay, and digital downloads have no postage.

  • Ways to pay: credit or debit card, Apple Pay, Google Pay and PayPal, including PayPal’s Pay in 3 where it is offered.
  • Secure payment: card payments are processed by Stripe and PayPal payments by PayPal. We never see or store your full card details.
  • When you are charged: your payment is taken when you place your order.
  • Price changes: we may change prices on the website at any time. The price you pay is the one shown when you placed your order.
  • Other currencies: if your card is not in pounds, your bank or PayPal converts the amount and may charge a fee. We don’t control that fee.

4. Digital downloads

Your download is available as soon as your payment is accepted. Nothing is posted.

  • Where to find it: you’ll find the download link on the order confirmation page and in your order confirmation email. If you have an account, it’s also in My account > Downloads.
  • What you get: one high-resolution digital photograph, supplied as a JPEG file in the sRGB colour profile at 300 dpi. This is the industry standard for professional printing, and the file can be printed at sizes from A4 up to A1.
  • Save a copy: your download link can be used 3 times and expires 100 days after your order. Please download your file promptly and keep a copy safe.
  • What you need: an internet connection and a device that can open standard image files. Downloads can be bought from the countries listed at checkout.
  • If the link doesn’t work: email us with your order number and we’ll fix it or send you a new link free of charge.
  • Colours: screens and printers show colours differently, so a print or screen may not match exactly what you see on our website. For the best print, use a photo-quality printer or a professional print service.

5. Your licence to use our photographs

When you buy a download, you buy a licence to use the photograph for your own personal use. You don’t buy the copyright. Every photograph remains © Pat McElhinney / My Highland Photography.

Print it for your own home, at any sizeSell, share or give away the digital file

Give a print as a personal giftUse it for a business, advertising or promotion
Crop or resize it for printing or displayPost it online or on social media without our written permission

The licence is for one person and can’t be transferred. If you break these terms, the licence ends and we may take action to protect our copyright.

To use a photograph for business or commercial purposes, email pat@myhighlandphotography.com and we’ll quote for a commercial licence.

6. Calendars and postage

Calendars are posted from Fort William to the address you give at checkout.

  • UK postage: £5 per order, shown at checkout before you pay.
  • Dispatch: within 1–3 working days of your order.
  • Delivery: usually 3–5 working days after dispatch in the UK. Busy periods such as December can take longer.
  • Outside the UK: we post worldwide. Postage is calculated at checkout and includes any import charges that are known at the time of your order. Your country may still charge import duty or other fees when the calendar arrives. These are your responsibility, and My Highland Photography can’t pay or refund them, so please check your country’s import rules before ordering.
  • Lost or damaged in the post: the calendar is our responsibility until it reaches you. If it arrives damaged, or hasn’t arrived 21 working days after dispatch, email us and we’ll send a replacement or give you a full refund.
  • Wrong address: please check your address carefully. If a parcel comes back to us because the address was wrong or it wasn’t collected, we’ll contact you. We can re-send it for the cost of postage, or refund the calendar.

7. Returns, refunds and your right to cancel

Calendars can be returned within 14 days for any reason. Digital downloads can’t be returned once your download has started, but faulty files are always put right.

Calendars. You can cancel within 14 days of the day you receive your calendar, without giving a reason. Email us to say you’re cancelling, then post the calendar back unused and in its original condition within 14 days. We refund the price and the original standard postage. You pay the return postage unless the calendar is faulty or we sent the wrong item. If it comes back used or damaged, we may reduce the refund by the lost value.

Digital downloads. At checkout you tick a box asking us to supply your download straight away. By ticking it, you confirm that you lose your 14-day right to cancel once the download begins. Our order confirmation email confirms this. Your rights if a file is faulty or not as described are not affected (section 8).

How to cancel or ask for a refund: email pat@myhighlandphotography.com with your name and order number. You can also use the model cancellation form, but you don’t have to.

8. If something is wrong

Everything we sell must be of satisfactory quality, fit for purpose and as described, as the Consumer Rights Act 2015 requires. Nothing in these terms reduces those legal rights.

  • Faulty or wrong download (the file won’t open, is damaged, or isn’t the photograph you ordered): we’ll send a working file. If we can’t, you’re entitled to a refund or a price reduction.
  • Faulty or damaged calendar: you can reject it for a full refund within 30 days of delivery. After 30 days, you’re entitled to a repair or replacement first, then a refund if that doesn’t fix it.
  • Please tell us promptly: email a photo or a short description with your order number. We’ll sort it out within 14 days of agreeing what to do.
  • Not a fault: small colour differences between screens and prints, or a change of mind about a download after it has been supplied.

For independent advice on your rights, contact Consumer Advice Scotland if you live in Scotland, or the Citizens Advice consumer service elsewhere in the UK.

9. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care.

  • What we never limit: our liability for death or personal injury caused by our negligence, for fraud, or for breaking your legal rights as a consumer.
  • Your devices: if a file we supply damages your device or other digital content because we didn’t take reasonable care, we’ll repair the damage or compensate you.
  • What we’re not responsible for: losses nobody could have foreseen, or business losses such as lost profit. Our products are for personal use.
  • Events outside our control: if something outside our control, such as severe weather or postal strikes, delays your order, we’ll tell you. If the delay is long, you can cancel for a full refund of anything not yet supplied.

10. Your personal information and emails

We only use your details to process and deliver your order, answer your questions and meet our legal obligations. We never sell your details. Our Privacy Policy explains what we collect, why, how long we keep it and your rights under UK GDPR. Our Cookie Policy explains the cookies on this website.

  • Marketing emails are optional. We only send news, new releases and offers if you tick the box at checkout or sign up on our website, then confirm your email address.
  • Unsubscribe any time: every email has an unsubscribe link, or you can email us. It’s free.
  • Order emails: you’ll still receive emails about your orders, such as confirmations and download links, because we need to send them.

11. Complaints, changes and the law

If you’re unhappy with anything, email pat@myhighlandphotography.com and we’ll do our best to put it right. We aim to reply within 2 working days.

  • Changes to these terms: we may update these terms from time to time. The version on the website when you placed your order applies to that order.
  • Governing law: these terms are governed by the law of Scotland. If you live elsewhere in the UK, you can also bring a claim in your local courts. If you live outside the UK, you keep any consumer protections your own country’s law gives you.
  • If part of these terms is invalid: the rest still applies.
